1. Pre-market vs post-market documentation

The EU AI Act requires a conformity assessment before placing high-risk AI on the market. Documentation must exist when the system launches.

U.S. state laws (Colorado especially) require annual impact assessments — meaning the documentation can develop over time, with the first assessment due within a year of high-risk deployment.

Operational implication: build documentation up-front for EU markets even if your U.S. presence is bigger. The EU pre-market regime is the more demanding gate; building once for EU typically covers U.S.

2. Notified bodies vs self-attestation

EU high-risk AI conformity assessments often require involvement of a notified body (third-party). U.S. state laws use self-attestation — the deployer signs their impact assessment, no third-party review required (with the narrow exception of NYC LL 144's independent bias audit).

EU penalties scale with global turnover (up to €35M or 7% for the most serious). U.S. state penalties are flat per-violation:

  • Texas TRAIGA: $10,000 per violation

4. Banned vs regulated

EU AI Act bans entire categories: social scoring by public authorities, real-time biometric ID in public, manipulative AI causing harm, workplace emotion inference, etc.

U.S. has no comparable bans. Texas TRAIGA prohibits AI "developed for" unlawful discrimination but does not ban use cases.

Operational implication: products legal in U.S. (workplace emotion analytics, facial recognition in retail) may be wholly prohibited in EU. This is a product-design constraint, not just a documentation one.

5. Enforcement structure

EU enforces through Member-State competent authorities, coordinated by the AI Office at the EU level. The structure is converging toward a single market.

U.S. enforces through 50 different state Attorneys General plus NYC DCWP. Each AG sets its own enforcement priorities. There is no central federal AI enforcement body equivalent to the AI Office.

Operational implication: U.S. compliance is fragmented by state — your AI compliance program needs per-state monitoring and per-AG relationships in the worst case. EU is more uniform but more concentrated risk.
