California Enacts AB 2025, Requiring Disclosure of Digitally Altered Images in Rental Listings
Assembly Bill 2025 was approved by the Governor and filed with the Secretary of State on September 27, 2026 as Chapter 572, Statutes of 2026. It adds Civil Code Section 1940.11 and amends Business and Professions Code Section 10140.8, extending the existing disclosure rule for digitally altered images in real-estate sale advertising to advertisements and promotional material for rentals. A person who uses a digitally altered image in rental advertising must include a disclosure and the unaltered image, unless the image or rendering was not originally created with a capture device, and a violation by a real-estate licensee is a violation of the Real Estate Law. It carries no urgency clause or special operative date, so it takes effect January 1, 2027 under California's default rule for statutes enacted in a regular session.
