California Enacts SB 574, Setting Generative AI Rules for Attorneys and Arbitrators
Senate Bill 574 was approved by the Governor and filed with the Secretary of State on September 30, 2026 as Chapter 858, Statutes of 2026. New Business and Professions Code Section 6068.1 bars an attorney from delegating the practice of law to generative AI and requires attorneys who use it to keep confidential and nonpublic information out of generative AI systems and to take reasonable steps to verify outputs and correct hallucinated content. Amendments to the Code of Civil Procedure prohibit filing papers with citations the responsible attorney has not personally verified, bar an arbitrator from delegating any part of decision-making to generative AI, and require disclosure before an arbitrator relies on AI-generated information outside the record. The Judicial Council must revisit its standard of judicial administration on generative AI. It carries no urgency clause or special operative date, so it takes effect January 1, 2027 under California's default rule for statutes enacted in a regular session.
